Terms of sale
1. Purpose
These terms of sale govern the sale of the products offered on this site by Essential Glow Design, sole proprietorship (entrepreneur individuel), 190 bis avenue Anatole France, 59410 Anzin, France — SIREN 977 561 950 — email essentialglowdesign@gmail.com, phone +33 7 81 62 20 97:
- crochet patterns in PDF format (digital products), sold individually or in bundles;
- physical items, delivered to an address in France.
Any order placed on this site implies acceptance of these terms. The version that applies to an order is the one online at the time of that order.
2. Products sold
2.1 PDF patterns
A pattern is a crochet pattern in PDF format, to download and read on a computer, tablet or phone, or to print. It explains how to make a crochet piece yourself.
A pattern is never sent by postal mail: no finished piece, yarn, hook or supplies are provided with it. The materials needed to make the piece are your responsibility.
The essential characteristics of each pattern are described on its product page.
2.2 Physical items
Physical items are shipped to your delivery address in France (Article 5). Their essential characteristics and instructions for use are presented on their product page.
Visuals marked as "illustrative visuals" are not photographs of the product delivered: they illustrate its appearance or use, and the written description on the product page sets out its characteristics.
2.3 Free pattern with a mug
When the offer is shown on the mug's product page, each mug purchased entitles you to one free PDF pattern ("1 mug purchased = 1 free PDF pattern"): a bundle of 2 mugs entitles you to 2 patterns, a bundle of 3 mugs to 3 patterns. The free patterns are chosen from those offered on the mug's product page; the patterns in a single order are different, within the limit shown on that page. They appear at €0 in the cart.
The free pattern is sent by email after payment and is never included in the parcel. It cannot be exchanged for money. It is subject to the same rules of use as purchased patterns (Article 8). If you withdraw from the purchase of the mug, see Article 6.4.
3. Order, prices and payment
3.1 Placing an order
To order, add the items you have chosen to the cart, then go to checkout. There you enter your email address, your billing details and, for an order containing a physical item, your delivery address and the delivery method.
Before you pay, a summary lets you check the details of your order (items, price of each item, any delivery costs and total to pay) and correct any input error, by changing the information entered or by going back to the cart.
The order is confirmed when you click the final payment button and the payment is accepted. You then receive a confirmation email summarizing your order.
We keep your order under the conditions described in our Privacy Policy. You can obtain a copy on request at essentialglowdesign@gmail.com.
3.2 Prices
Prices are shown on the product page in the currency of the market you are shopping in (euros or US dollars).
- PDF patterns: the price shown is the final price due: no delivery or handling fee is added, as it is a digital file.
- Physical items: delivery costs are added to the price of the items: "Home delivery", €3.99 per order.
The summary shown before payment states the price of each item, any delivery costs and the total to pay.
3.3 Payment
Payment is made online when you place the order, using the payment methods offered at checkout.
4. Delivery of patterns
Once payment is confirmed, you receive by email a personal download link giving you access to your PDF pattern. The email address used is the one entered with the order. The same applies to a free pattern received with a mug.
If you do not receive this email, check your spam folder, then write to us at essentialglowdesign@gmail.com with your order number: we will send you the link again.
To open the file, you need a PDF reader (available free of charge on most devices).
5. Delivery of physical items
Area: physical items are delivered only to an address in France.
Delivery time: the delivery time is stated on the product page, before you order. If no delivery time is stated, the item is delivered without undue delay and at the latest 30 days after the contract is concluded (Article L.216-1 of the French Consumer Code).
Delay: if the item is not delivered within the agreed time, you can ask us in writing (email or letter) to deliver it within a reasonable additional period. If delivery still does not take place within that period, you can terminate the contract in writing.
You can also terminate the contract immediately, without granting an additional period, if we refuse to deliver the item, or if meeting the delivery time was an essential condition of your order, given the circumstances or an express request from you before the order.
When you terminate the contract on this ground, we refund all the sums paid at the latest within 14 days of the date on which you terminated it (Articles L.216-6 and L.216-7 of the French Consumer Code).
Transport risks: the item travels at our risk until you, or a third party designated by you other than the carrier, take physical possession of it.
Damaged parcel: if possible, report the damage to the carrier, giving specific details, then email us photos of the parcel and the item, with your order number. These steps make your request easier to handle; they do not deprive you of any of your legal guarantees (Article 7).
The patterns in an order, including a free pattern, are sent by email (Article 4): they are never in the parcel. The details are set out in our Shipping Policy.
6. Right of withdrawal
You have a period of 14 days to exercise your right of withdrawal, without having to give reasons for your decision and without penalty. The starting point of this period and the return arrangements depend on the product.
6.1 PDF patterns
The 14-day period runs from the conclusion of the contract (for an order that also contains a physical item, see Article 6.3). This right still applies even if the file has already been downloaded: we currently do not apply any exception to the right of withdrawal for digital content.
As it is a file, there is no return by postal mail and no return cost. The refund is made at the latest within 14 days of receipt of your request, using the same payment method as the one used for the order, and access to the file is deactivated.
6.2 Physical items
The 14-day period runs from the day on which you, or a third party designated by you other than the carrier, take physical possession of the item. For an order of several items delivered separately, it runs from receipt of the last item.
After telling us about your decision, you send the item back without undue delay and at the latest within 14 days of telling us, to the address: Essential Glow Design, 190 bis avenue Anatole France, 59410 Anzin, France. The cost of sending the item back is paid by you.
We refund the price of the item and the original delivery costs, up to the cost of standard delivery, at the latest within 14 days of the day we are informed of your decision. The refund is made using the same payment method as the one used for the order, unless you expressly agree to another method, and does not cost you anything. We may withhold the refund until we have received the item back or until you have provided proof that you have sent it, whichever comes first.
You may only be held liable for any loss in value of the item resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning.
6.3 Orders containing patterns and a physical item
You may withdraw from the whole order or from only part of it. For such an order, the 14-day period runs, for the whole order, from receipt of the item (or of the last item). Only physical items need to be sent back, under Article 6.2; patterns are refunded under Article 6.1 and their access is deactivated.
6.4 Free pattern with a mug
The free pattern is not charged to you. If you withdraw from the purchase of the mug, you have nothing to send back for the free pattern and no amount is deducted from your refund for it. Access to the free pattern may be deactivated.
6.5 How to exercise this right
To exercise this right, write to us at essentialglowdesign@gmail.com or send us a letter at the address given in Article 1, stating your name, your order number and the items concerned.
You may use the model withdrawal form in the appendix. Using it is not mandatory: any statement clearly expressing your decision to withdraw is enough.
Each request is acknowledged and then reviewed individually by a person, and is never refused automatically.
7. Legal guarantees
Independently of the right of withdrawal, you benefit from the legal guarantees provided for by French law: the legal guarantee of conformity and the guarantee against hidden defects.
These guarantees are owed by Essential Glow Design, sole proprietorship, whom you can contact at 190 bis avenue Anatole France, 59410 Anzin, France, by phone at +33 7 81 62 20 97 or by email at essentialglowdesign@gmail.com.
Using the legal guarantee of conformity costs you nothing: if an item has to be sent back to us for this reason, we pay the return costs. The return costs paid by you mentioned in Article 6.2 only concern withdrawal.
7.1 Physical items
The seller is liable for any lack of conformity existing at the time of delivery of the item that appears within two years of delivery (Articles L.217-3 et seq. of the French Consumer Code), as well as for hidden defects (Articles 1641 et seq. of the French Civil Code). An item damaged during transport is covered by these guarantees.
To use these guarantees, write to us at essentialglowdesign@gmail.com stating your order number, a description of the defect and, if possible, photos.
Legal information on the guarantees applicable to physical items:
The consumer has a period of two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to provide all the updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the goods are delivered back in working order.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
7.2 PDF patterns
If the file you receive is unreadable, incomplete or does not match its description, contact us at essentialglowdesign@gmail.com: we will provide a conforming file or refund you.
Legal information on the guarantees applicable to patterns (digital content supplied in a single act of supply):
The consumer has a period of two years from the supply of the digital content or digital service to obtain the application of the legal guarantee of conformity if a lack of conformity appears. For a period of one year from the date of supply, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.
The legal guarantee of conformity entails the obligation to provide all the updates necessary to keep the digital content or digital service in conformity.
The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following the request, free of charge and without major inconvenience.
The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and obtain a full refund in exchange for giving up the digital content or digital service, if:
1° The professional refuses to bring the digital content or digital service into conformity;
2° Bringing the digital content or digital service into conformity is unjustifiably delayed;
3° The digital content or digital service cannot be brought into conformity without costs being imposed on the consumer;
4° Bringing the digital content or digital service into conformity causes major inconvenience to the consumer;
5° The lack of conformity of the digital content or digital service persists despite the professional's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request that the digital content or digital service be brought into conformity first.
Where the lack of conformity is minor, the consumer is only entitled to cancel the contract if the contract does not provide for payment of a price.
Any period during which the digital content or digital service is unavailable for the purpose of being brought back into conformity suspends the remaining guarantee period until the digital content or digital service is supplied again in conformity.
The rights mentioned above result from the application of Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.
A professional who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in exchange for giving up the digital content or digital service.
8. Use of patterns
The PDF pattern is intended for the personal use of the buyer. It may not be copied, shared, resold, distributed or posted online, in whole or in part. This rule also applies to the free pattern received with a mug.
You may, however, sell in small quantities the pieces you have crocheted yourself from the pattern.
9. Complaints
For any question or complaint about an order, write to us at essentialglowdesign@gmail.com or by postal mail to Essential Glow Design, 190 bis avenue Anatole France, 59410 Anzin, France. For a physical item, attach photos if possible.
10. Governing law
These terms of sale are governed by French law. As a consumer, you retain the benefit of the mandatory protective provisions of the law of your country of residence in the European Union.
